Troy man charged with attempt to burglarize occupied home

A Troy man was arrested Tuesday on a charge of second-degree burglary for allegedly attempting to burglarize an occupied residence on Academy Street on August 14.

Troy Police Chief Randall Barr said investigators spotted Jashaun Cordell Lawrence, 19, on foot in the 800 block of North Three Notch Street and arrested him without incident.

The attempted burglary occurred around 2 p.m. on Monday, August 14 in the 800 block of Academy Street according to Barr.

No one was injured in the course of the crime.

Lawrence was processed through the Troy City Jail and incarcerated in the Pike County Jail on a $5,000 bond.

Second-degree burglary is a class B felony punishable by 2 to 20 years in prison.

Second-degree burglary is defined under Alabama law as the crime committed when someone:

“…knowingly enters or remains unlawfully in a building with intent to commit theft or a felony therein and, if in effecting entry or while in the building or in immediate flight therefrom, the person or another participant in the crime:

(1) s armed with explosives;  or

(2) auses physical injury to any person who is not a participant in the crime;  or

(3) n effecting entry, is armed with a deadly weapon or dangerous instrument or, while in the building or in immediate flight from the building, uses or threatens the immediate use of a deadly weapon or dangerous instrument against another person.  he use of or threatened use of a deadly weapon or dangerous instrument does not include the mere acquisition of a deadly weapon or dangerous instrument during the burglary.

(b) n the alternative to subsection (a) of this section, a person commits the crime of burglary in the second degree if he or she unlawfully enters a lawfully occupied dwelling-house with intent to commit a theft or a felony therein.”
