After three continuances, Brundidge City Councilman Arthur Lee Griffin will stand trial Nov. 12 for charges that stem from an April 2 traffic stop involving Ozark resident Alfred Schultz.

During Griffin’s last trial date, he was given a continuance despite objects from the state of Alabama after his attorney Joe Lampley requested in an order to have time to receive information that had been subpoenaed from Brundidge’s Wal-Mart Distribution Center.

Lampley told District Judge Paul Sherling that Schultz, the man who, according to the warrant, claims Griffin assaulted him by shoving a shotgun into his neck while he was in handcuffs, was an employee of Wal-Mart Distribution.

Lampley said information provided on his employment application could be useful in the case against Griffin.

Attorneys from both sides met in the judge’s chambers prior to Sherling granting the continuance.

Lampley told the court he had contacted Wal-Mart officials in the home office in Bentonville, Ark., and officials said the information subpoenaed would be forthcoming.

He also said he would make the subpoenaed record available to the Coffee County District Attorneys Office.

Griffin pleaded not guilty to the charges of third degree assault.

Schultz’s wife, Anna, previously told The Messenger someone allegedly followed her husband in his truck, as he left his job.

Anna Schultz said the alleged incident ended in Coffee County, she also stated the Brundidge Police Department, pulled her husband over, told him to get out of his vehicle and handcuffed him.

The attorneys for Schultz are Jeff Moore and Griffin Shirley.

The trial will be held at 1:30 p.m. at the Coffee County Courthouse in Elba.
