Murder suspect remains in jail

Man charged with brother's murder

Alabama State Troopers continue to investigate a fatal wreck that resulted in a Brundidge man being charged with the murder of his brother.

Fabian Texcahua, 21 of Brundidge, remains in the Pike County Jail after losing control of his vehicle early Sunday morning, resulting in the death of his younger brother Luiz Texcahua, 20.

Trooper Spokesman Kevin Cook said initial investigation indicates Fabian was traveling above the posted speed limit and that alcohol was a factor in the incident.

Due to rainy weather conditions, investigators were unable to conduct skid tests to determine the vehicle’s speed Monday, but Cook said those tests will be a part of the investigation.

In addition, Fabian’s blood was drawn at Troy Regional Medical Center, and Cook said those labs have been sent to the Alabama Department of Forensic Sciences to be tested for alcohol content.

Cook said it may be the end of the month before those results are back.

Fabian has been charged with murder by the state, based on what was found in the investigation.

“It all depends on the trooper investigating and what he finds at the scene,” Cook said. “From what I was told, it was pretty much cut and dry what happened so the troopers got the OK from the District Attorney’s office to charge him.”

The incident occurred around 5:30 a.m. when the two were traveling on County Road 5520, and Fabian lost control of the vehicle. His brother was ejected from the passenger’s window and pronounced dead on scene by Pike County Coroner Jerry Williams.

Cook said he is unsure where the two were traveling.

Fabian’s bond has been set at $50,000.

Just send him back to Mexico. I think living with his brothers blood on his hands and having to go back where he came from is punishment enough. I'm sure that he did not intentionally kill his brother. Charging him with murder sounds extreme. I guess if he was drinking, I can understand...

Yes, just because he is charged with Murder, doesn't mean that he intentionally intended to cause harm. The law reads of Murder, that if one operates a motor vehicle in such a manner that would or could cause an extreme indifference to the quality of a person/persons life and does cause injury/ or death then it constitutes that charge.

No matter where he's from my condolences go out to this young man. Two young men made a tragic error in judgment and now if he's convicted two lives will be destroyed. Before we convict him in the court of public opinion let's all try to remember some of the not so bright stuff we did when we were young. Let he without sin cast the first stone.

It amazes me how unfeeling some people can be just because someone is not the same race as they are. It doesn't matter if these were two whites, blackes, pinks, or purples, they are still human beings! We all sit back and wonder why our country is still stuck in the old days and cannot move forward; it is because of comments like those that were made is the reason this country cannot move forward. I truly pity those. My thoughts go out to the family because not only did they loose one child but possibly two.

Of course this is a tragedy and I'm sure the brother who was driving feels awful now, but I don't know why the comments of Linden are found to be racial. I agree with him. If the guy is illegal, which we do not know if he was or not, then he should be sent back to Mexico so our tax money isn't used to hold him in jail and to feed him for years. I don't think I'm being racist by saying that illegals are hurting our country. To an extent its not their fault they are here. It is our government who doesn't want to lose the Latino vote who is to blame for not protecting our borders. I know this is a change of subject, but I just didn't see anything racial about Lindens comment.

Trojan97,The comment is racist because Lindens assumes he's Mexican because he's Hispanic, Could it be possible that he is from Puerto Rico which is part of the US; as a matter or fact he could be from Guatemala, El Salvador, Honduras or maybe Brazil. So Lindens comment about being Mexican is basically assuming if your Hispanic your from Mexico.....thats racist...And there are plenty of Hispanics here in this country who are not Mexican and do have papers.... And as far as sending him home if he is illegally here I agree, but what your saying is its OK to commit a crime in this country, in this case Murder and if your illegally here will send you back home so our tax money isn't wasted feeding him in jail and a few days after being deported he can easily come back in through the border, thus in fact getting away with Murder and maybe the next time he decides to drink and drive he can maybe take out a family of four on there way home from church. You might want to consider running for public office and I'm sure the the illegals sitting in jail all across this country would love to have that "get out of jail free card" if your illegal, you would have Americans claiming to be illegal just to get out of jail. Commit a crime...do the time no matter where your from or your skin color, he made a bad choice and now he must be held responsible, illegal or not, because how would you feel if it was someone you knew that was involved and died in that accident, would you still want to send him Mexico or would you want him to do his time for that friend that you lost at his hands.....I'll bet you'd change your mind and I'll bet you would want him to serve every minute of his sentence no matter what the tax burden.

He was mexican , i was at the hospital when they brought the dead one in and then the state troopers brought the brother in for a blood test

I think murder is a bit over-the-top, manslaughter maybe, if the driver was drunk since that hasn't been confirmed either. But what about the deceased individuals decision to ride in the vehicle with an alleged drunk driver behind the wheel? Shouldn't he have some responsibility for his actions, unless a gun was being held to his head he didn't have to get in the vehicle did he? If he had simply broken a bone the driver would not be charged with battery. What if the driver wasn't drunk, what if the accident was caused by the wet road? Should we now incarcerate the manufacturer of the asphalt because it's "slippery when wet", how about the state or county workers that paved the road...maybe they did something wrong. Did the accident happen in a curve, was there a warning sign? Why does the "family" have to be on their way home from church, if they are on their way home from the beach do they deserve to die? Finally, don't tell me that any illegal alien is not personally responsible for being here, they know they need a visa just like I know I need one to visit most other countries, personally, I think I should need one to visit any other country! As for Puerto Rico, it's a U.S. territory which basically means they have all the rights of an American citizen but NONE of the taxes so should either become a state or start paying taxes like the rest of us then maybe we can put up signs, pave roads with something that isn't slippery, hire enough cops so no one drives drunk without getting caught.
